Weld to Weld clearance between Nozzle Pad and Vertical Weld Seam

Hi,

Good day.
Regarding the captioned subject, I would like to get your opinion if in case that min. weld to weld clearance as per API 650 fig. 5.6 does not met (10" or 8t), is there any technical explanation that it is still acceptable?
Tank 1st shell course thk is 0.67"/17mm. Weld distance is only 150mm.
Tank is modified to fit on new service.

Not unless it was in an assembly and post weld heat treatment had been performed prior to welding of the adjacent shell joint of the tank (5.7.3.2).

The 835 horizontal dimension is shorter than it should be.

The repad is thinner than the tank shell - is it OK?

What is the shell material? If it is API Group IV or above this nozzle would need to be in an insert plate and PWHT (5.7.4.3).
