Wall Horiz Rebar--Top or Other Bars??

In the past I have provided Class "B" laps in reinforcing for wall horizontals as required by "Other Bars" per ACI 318 in lieu of "Top Bars". I can't find the reference that makes this acceptable (something like this comes to mind) "horizontal bars in walls need not be considered top bars". Used to have it, but now I can't find it. Can any help with a reference?
 
The definition of a top bar is any horizontal bar with more than 12" of fresh concrete below it. Based on that I have always considered horizontal wall bars as top bars.

I don't recall a wall bar exclusion.
 
The reason for the requirement is to provide for settlement of the concrete under the bar, hence loss of bond strength. Concrete settles in a wall just as it does in any other element so there is no valid reason for an exclusion.
