Using material with note G5

Can anybody help to refer to a clause of asme which permits to do the following design?
A tower has been designed with shell courses plate sa 240 304l with g5 note and some top courses with just sa 240 304l without considering note G5, does anyone see any paragraph of code asme or other permit this?
 
Generally speaking if a thing is not prohibited, it is permitted.

I didn't say it was good practice :)

A "tower" ??? .... What do you exactly mean ??? .... What is the Design Code for this "tower" ??

Do you mean a Distillation Column designed to the ASME Pressure Vessel Code ?

... or something else ??

Post the ASME documents, Code edition, Vessel nameplate etc .... so we can no more infromation and answer your question

1. Check if nozzle flanges are also with same material in forged or other form. There will be a high possibility of flange leak due to distortion/strain at the vessel pressure.
2. As it is the same material, for all shell courses, one needs to be careful with pressure testing the column, regardless of the G5 note. if the allowable stress S value is used above 2/3 of YS up to 90% of YS, the general test pressure rule will exceed the YS of the material which must be lowered.
