Stair railing height

CFR 29.1910.23(e)(2) says that "A stair railing shall be of construction similar to a standard railing but the vertical height shall be not more than 34 inches nor less than 30 inches from upper surface of top rail to surface of tread in line with face of riser at forward edge of tread."

OSHA 3124-12R 2003 "Stairways and Ladders A Guide to OSHA Rules" on Page 14 left column says "Stair rails installed after March 15,1991, must be not less than 36 inches (91.5 cm) in height."

So, which is it? 34" max or 36" min ?
 
If it is part of a means of egress, a guard at 42" is required in addition to the handrail. (Refer to IBC 2006 Sec 1013).
