Is this legit? I can see what this is trying to accomplish, but is there a better way to do this or is this fine? I was under the impression you can only use diametrical callouts on a circular feature.

Assuming you are going by ASME Y14.5 simply put - no. Regardless of the diameter attached to the tolerance in the FCF, position must be applied to a physical FOS. The intersection of two theoretical centerlines/planes is not that.
