I had a house built by a local builder. I have been fighting with them for 2 years now on problems, which is leading to court. During construction I noticed that the concrete walls were not filled with concrete when finished. Some where covered over the top, but there were holes you could stick you finger into. Now I have water damage coming through the walls. I just noticed tonight that the water damage looks like the outline of the inside of a block. Could I be right? Is there a way to fix this and what does it cost for something like this?

My thought is that you really need to have a qualified structural/geotechnical engineer inspect and evaluate your problem. Before hiring one I would suggest soliciting recommendations from friends,neighbors and better business bureau. If you live in the United States I would suggest going to the H.A.D.D. (Homeowners against deficient dwellings) website.

Hire an attorney NOW. In my experience, you need to hire a good, ethical lawyer familiar with these types of claims - first. Be sure the attorney has construction litigation experience. The lawyer will know "the lay of the land" - and which engineers you should not hire. Unfortunately, some engineers will take a position solely based on who hires them, not the merits of the case. The lawyer will advise you to any important legal milestones - like statutes of limitations - that you may be facing. You may be approaching (past?) statute-of-limitations issues in some states (2 years from the date the defect was identified); you have no time to spare. Do it next Monday to protect your claim. Remember: "He who hesitates is lost."
