i have an observation tower to design, first thing is it considered an open sign right if not what is an open sign ? Second thing in seismic is it considered as inverted pendulum ?

If you look in ASCE 7-10 Figure 29.5-2 Open Signs & Lattice Frameworks, note 1. it says "Signs with openings comprising 30% or more of the gross area are classified as open signs." If the tower has 4 sides and is built of walls (and not lattice framework or trusses) but has some openings in it, you will need to look at Chapter 26 page 241 "Building, Open". From there to the next page it describes in detail what an open building, a partially enclosed building, and enclosed building is based on the ratios of gross area to open area.
 
ok, does it considered as non building or building in Seismic Analysis ?
