Aggregate Gradation - Out of Specification Price Adjustment

Is anyone aware of any standard procedurers or practices that may be available or comonly used for adjusting payment for out of specification aggregates?

We are currently wrapping up a DOT/FAA project in which we had several QA samples of aggregate Subbase and Surface Course with out of spec test results.

The DOT has proposed 2% deduct per % deviation for +#40 sieves and 4% deduct per % deviation for -#40 sieves.

I am just researching for information that may be available or others experience in this situation. I haven't turned up anything so I figured I would give it a shot on Eng Tips.
