When considering code requirements, every code paragraph should be considered mandatory unless an exemption exists that will permit construction without meeting the requirements.
At first glance it appears that this was a case of overpressure. The fire tube is external pressure design. It there was a slight out of round then all bets are off. External pressure relies heavily on stability and not so much on strength.

I guess this depends upon the material used. If the material specification shows an upper limit then it would appear that this is permitted. If the specification does not impose an upper limit they you would need to take tensile specimens.

You may have a clause in ASME VIII div 1 which states that it may be exempted from the requirements of the code book but have you considered the requirements of CSA B51 of the Alberta Safety Codes Act? Pretty much every jurisdiction would have a law which states that you need to use some code...
