Its the lawyers.  There are some genuine cases of negligence, for example drunken drivers, but many times these frivolous lawsuits just increase costs.  I've heard that 1/3 of the cost of a common stepladder is the many warning labels and the legal talent to word them just so.

It's not just the lawyers.  It's the clients happy to take any opportunity to make a buck off a situation.
