Kitchen Hood Exhaust Replacement

We are adding a new makeup air unit to a kitchen. The existing hood and exhaust is very old.

Is it acceptable per code (IMC, IEBC) to replace the hood exhaust fan with one that matches existing airflow? The type of hood and the application it is being used for would require alot more CFM per today's standards according to IMC. It would probably be more cost effective to replace the entire hood with a new listed hood but the client does not have the budget for a full replacemement.
 
Depends on your local code and AHJ. In my area, I would start consulting IEBC to determine what level of remodel this is. That would help determining if you can use grand-fathered codes, or have to meet current code. Note, you also have to be sure the old hood actually met code at the time it was permitted and installed. If it also was too small based on the old code, it is NOT grandfathered in.
 
This is a level 1 alteration, there are no architectural changes to the room. The other option I was thinking is just to repair the fan, that way it's not considered a replacement.
