If I was to only do deep hole and perc tests would I still need both liability and E&O insurance? Thanks.

Yes. General liability because you are going on a jobsite, Professional liability because of the performance of a test and the likely interpretation of that test result, thus its "downstream" implication of others relying on your data.

This is one that can really cost you. In lean years, I usually skip insurance but I no longer do perc tests or septic systems because of the liability (ie contractor uses inadequate soil, drain tile installed wrong, customer fails to maintain system, you hit the only good soil and the rest is no good.

Too many variables you can't control.

Good luck,
Dermott

If you are preparing engineering reports - even if they are not stamped, you need the E&O. I know from experience. I was sued for a simple job that my lawyers said should never have been filed (spiteful developer). I had dropped my insurance due to the economic drop and ended up paying the defense cost myself. Even though the lawsuit never went anywhere, I still spent $70,000 for legal fees. IMHO, E&O insurance would have been much cheaper. I will never go without E&O insurance in the future.
