Fish Passage Design - Maximum Velocity

I'm doing a fish passage box concrete culvert design using STREAM SIMULATION design option, from HY-8 the Velocity at outlet (10 Years discharge) is 9 f/s, more than the standard requires maximum velocity for fish which is 5 f/s. One is that right? some one tells me if using STREAM Simulation do the fish passage design, no worry about the velocity.the maximum velocity requirement does not apply if using STREAM SIMULATION design option? I get confused. Thanks a lot.
 
I'm not completely clear on the requirements, as I haven't done one of these in a while. But I would question whether it's necessary to provide fish passage during a 10 year flood, or whether perhaps the fish could wait and swim through the culvert once the flood was over.
