CMP-50 communication cable

An owner has requested CMP-50 plenum communication cable. As far as I can tell, CMP-50 was a listing that was proposed to be added to the National Electric Code but was rejected for the 2002 code, therefore is it not a cable that should be used if it is not an acceptable listing in the NEC? It is not listed in section 800 of the 2005 NEC>
 
Section 800.179 (A) states the following for CMP conductors:

Type CMP communications plenum cable shall be listed as being suitable for use in ducts, plenums, and other spaces used for environmental air and shall also be listed as having adequate fire-resistant and low smoke-producing characteristics.

So long as the material has been tested to the requirements of NFPA 262 and it meets the flame spread and smoke obscuriation requirements, it appears the 05 NEC allows it.
