BTEX Solvents Ban

A vendor told me that xylene treatments are banned in California, Montana, North Dakota, Alaska, and will be soon prohibited in Colorado. I've not been able to substantiate any of this. Is anyone here familiar with states regulating xylene for asphaltene treatments? I'm most interested in Colorado's regulations.
 
Xylene isn't banned, the regulations and paper make it expensive. Under CA prop 65, all new cars have a warning label saying that cars have crud and other street language terms that are dangerous. Coca cola reformulated its carmel coloring because some ppm of a burned sugar is dangerous.
