AISC Certification Requirement

Does anyone ever look at the requirement that a steel shop be AISC certified as being a closed spec, which is illegal on public projects? I also want to point out that the fee structure for fabricators actually means that a steel fabricator owes a cut of each ton of steel they fabricate to AISC.
 
None of the government projects I've worked on have viewed it that way. In fact, they have usually asked me to required AISC certification. It's a level of quality, not a sole-source. At least that's been my experience.
 
I understand the intent and agree the level of quality should be maintained but the certification and cut of the project AISC takes seems to be a legal issue.
 
I've required AISC certification on many government projects. State, Federal, DoD, DoS. No problems ever.
