3rd floor egress court across 2nd floor roof?

IBC 2006, Section 1024.5 allows egress courts serving "as a portion of the exit discharge in the means of egress system". In this instance the 3rd floor is proposed to be built out for about 1/2 the building footprint with an assembly use inside. To get the third exit for that use, we are proposing to exit out of the third floor across the roof (pavers) of the 2nd floor to an enclosed stair that discharges to a public way. The building is fully sprinklered, the exterior wall separating the 3rd floor from the "egress court" is 1 HR protected, as is the stair. Our local building official is challenging this interpretation. Any thoughts?

Your description is a bit unclear, but it sounds to me that if your travel length to the exit is within the length the code allows that this should be a viable exit. This is similar to a mezzanine, where the travel length is measured from the most remote part of the mezzanine + stair length + remaining distance to exit.
