Specifications - Buy America Act (1982)

Specifications - Buy America Act (1982)

Hello all. I came across a question while writing specifications for a project and was hoping someone might be able to point me in the right direction to find further information.

I have a client who is used to working on federally funded transportation projects subject to Buy America provisions. After some bad experiences with foreign manufactured steel, they have requested that all of their projects include the Buy America provisions including projects not transportation related nor federally funded. My question is can the Buy America provisions be applied in this case, or are there other regulations related to federal trade that would make preclude this restriction? If Buy America cannot be included as such, is there another act comparable to this or would the best way to handle this be to include individual material specifications?

RE: Specifications - Buy America Act (1982)

If you are talking about private clients who fund their own projects, couldn't they just incorporate the desired language from the public act into their project's general provisions? Business life is pretty much whatever you can agree is mutually acceptable, unless some provision is legally unenforceable.

RE: Specifications - Buy America Act (1982)

I agree with thaidavid40; if this is a privately funded project the owner can add what he pleases. If this is a public project with Federal funding then you are bound by agency rules. Buy American is still in effect.

RE: Specifications - Buy America Act (1982)

Remember Canadian made items are excluded from buy American even for innocuous items such as SS bolts and nuts for railings on top of parapet walls.
