it happens when I rotate the plane with a sketch over some point (say, x-y plane).
is there a way to avoid it?

Is there a way to avoid that ? I really don't know
But when it does happen edit the datum plane and flip the normal (under Plane Orientation, reeverse direction) and that should fix it.

You might need to redefine your horizontal reference.

Yes, maybe make your horizontal reference a feature that will move with the rotation of the plane
