We have an installation of a hydraulic unit that has an explosion proof motor on it. It is in a Class 1 Div 1 area. The motor has additional leads on it for a thermal switch. While, I understand this is a very good idea to hook up to the starter/VFD, does this create a safety hazard if it is not and a violation of NEC code?

The switch should be within the explosionproof enclosure, and the lead terminations need to be within an explosionproof enclosure as well. If so, it's fine.

Most of the explosionproof motors that I have seen with the internal thermal switch had instructions requiring that you wire the switch into the control circuit so as to pevent the motor from running when the internal termperature is too high. If there are instructions saying this, then failure to comply with those instructions would be a violation of 110.3(B).
