Has anyone ever been involved with an appeal of Osha requirements? Our client is trying to get a ladder down in a secondary containment tank. Because of the stiffeners at the top of the tank, there is not the proper clearance around the tank. Thanks

That might be a variance, rather than an appeal.
Is this a permanent ladder? If not, I don't know that ladder clearances would apply to it.

Consider taking your problem to your local OSHA office, and ask for their help in solving your problem. Maybe at first by phone to try to find the right person. What are your options from their standpoint? Go knowing the general rules which surround this type of issue, so you look smart on the matter, you have considered the options, here are a couple possible solutions. They are not usually/always unreasonable if you go to them for help in the first place. Get to know a few people in that office, so you know the best, go to, most reasonable, person in that office. Remember that until you get in a real serious fight, the interpretation (blessing) of the local office carries the most weight. They will work with you usually, unless you get tangled up with some real jerk. They are much less nice, when you haven’t involved them up-front, when you do something wrong, and then someone gets hurt. That’s too late to enlist their help. My understanding is that, of late, they have been charged with trying to be helpful, when asked, not just with being difficult to deal with at all times.
