Looking for New York State Professional Liability Insurance Requirements

Looking for New York State Professional Liability Insurance Requirements

Looking for New York State Professional Liability Insurance Requirements

(OP)
Hello All,

I am looking to work on the side part-time and I was wondering if anybody had a link to the law that states what amounts of professional liability insurance engineers in NY need to carry?

Thank you in advance.

RE: Looking for New York State Professional Liability Insurance Requirements

It's been a while for me, but I don't think the law requires any insurance. Clients require it. Some do, some don't.

Don't take muy answer as golden though...

Best to you,

Goober Dave

We were never required to carry insurance until someone asked for it. Not sure if that varies by state, but you should ask your client what they require if any.

I believe that in NY we are required to carry PL Insurance 500000/1000000 (occurance/year) when performing any engineering tasks (stamping). I also carry general liability insurance.

I just can't find the law, but I'm 90% sure it is law in this state.

Oh, I forgot. As an update I did get PLI from a very good company. Coverage was billings up to $50,000 @ coverage of $1,000,000 / $2,000,0000 for around $1,800 year. I don't want to throw around that company name on here but if you email me I will gladly give a referral. They were great to work with. First time getting the PLI.

Thanks again for all of the help.

RE: Looking for New York State Professional Liability Insurance Requirements

I can't even think of a category of regulation that would require professional insurance. It would almost have to be under the licensing laws, but that is mostly just implementation of the NCEES language which does not mention insurance at all. I've never looked at New York (no interest in getting a license there), but the two states that I am licensed in do not mention PL insurance anywhere. Both states talk a lot about professional responsibility and subsequent liability, but don't mention how a P.E. is going to mitigate his own risks.

Wow $1800 is a good price compared to what I pay. Of course I'm in a slightly different field than you are.

NSPE survey of insurers:

In California, there appears to be no such legal requirement. The only part of the law that talks about insurers is their duty to report claims made against insured PEs.

Adamjdorn, I'd be interested in knowing who this company is and getting their contact info. You can email me by clicking on the link in my handle. Thanks.

We are paying about $2400 a year which seems pretty good to me. Ended up going through USAA with a discount. Anyone can get that discount because USAA is not just for the military. They cover up to $1mil on billings up to around $100k. We have an issue because one client wants up to $2mil but we don't bill enough yet to reach that point.
