i just finished placing unground communication line on state ROW dot contact came out reviewed my permit signed off on it , while i was beginning to trench, and left. ten days later he called and notified me i cut a water line belonging to state . and that i needed to repair, now normaly i will assist on digging up and repair regardless who at fault, but by this time i had allready moved all equipment about 200 miles away, well he said he knew the line was there when he came and reviewed permit, but he never mentioned to me. i want to know , if i am liabl for that water line , , i know it is my responsability to notify every one , in this case they did know ,

you may or may not be technically liable, but which do you think will cost less?

a) fight this using your attorney vs the state attorney general
b) go back and fix the waterline

Most States that have "Call Before You Dig" regulations put the onus on the utility owner to locate their facilities. If they don't locate them, the contractor is not liable for any damage. As cvg pointed out though, it might be cheaper in the long run to just fix it. You also need to consider whether or not you will be working in the State ROW again. If you are, it might be better in the long run to fix it. You can either self perform or hire a small local contractor to do the work.
