Imagine the following situation:

assy1:
  part1
  part2
  part3
  subassy1

which I want to turn in:
assy 1:
  subassy 1
    part1
    part2
    part3

Now, drag/dropping part 1-part 3 from assy 1 to subassy 1 will give me this. But is it possible to keep the constraints between them intact? Since the constraints are between the to part and don't really have anything to do with what assembly they are in, I don't see why this wouldn't be possible.

Thanks in advance.

P.S.: You could save assy1 as subassy 1 and import it in assy 1, but I'm looking for a less tedious way. Since the above will cause problems when not being careful because of teamcenter integration.

try to switch off constrains, than put subassembly on top and then try to swtich on again

It's not supported.
Add an Enhanced Request.
This is possible because new assembly constraints doesn't have parent link.

Either call GTAC or go to...

Help -> Online Technical Support -> Log an Incident with Technical Support

...and if you describe what you're submitting as being an Enhancement Report, it will logged in that manner and you will be notified of the ER number which has been assigned to it.  If and when any action if taken on your request, you will receive subsequent notification to that effect.
