Occupancy Category for Assisted Living Facility

Would a four story assisted-living facility be categorized as   Occupancy Category III (i.e. a health care facility with 50 resident patients or more, but not having surgery or emergency treatment facilities).

Any chance 300 people could be in there??

If not, or regardless, just follow IBC2009

This facility will definitely house more than 50 residents and my inclination would be to classify this as Occ. III facility.  However, it has been classified as an Occ. II facility and I am trying to discern if the reason for this classification is because the building is an assisted living facility, rather than a nursing home.
