If I have a WPS using GTAW root and hot pass and SAW fill and cap that only states 1G position can I weld the GTAW root and hot passes in the 5G position? Is this legal in ASME Section IX? If so where in Section IX can I find this?

For WPS qualified without impact testing, yes. However, you need to revise the WPS. See QW-405.2 for GTAw and QW-405.1 for SAW.

Just having my welders qualified to weld GTAW in the 5G is not acceptable. My requirement for impact testing dictates that I should develop a new WPS to be in accordance with Section IX.
Is this correct?

No, it depends on the welding process(es) used. look at QW-203. Welder qualification are discussed in QW-303.

All the WPS proves is that the listed weld filler and the type of weld process will successfully 'stick' two pieces of the listed P# of material togather. It is a test of joint strength and soundness.
It is the WPQ - welder qual - that is a test of skill.
