NYS DEC Notice of Termination of Post Stormwater Practices

NYS DEC Notice of Termination of Post Stormwater Practices

NYS DEC Notice of Termination of Post Stormwater Practices

(OP)
We are getting ready to file a NOT with the NYSDEC.  We were performing stormwater inspections up until now; my question is do we still need to continue performing these inspections now that the NOT is filed or does the NOT signify the complete end of inspector's needs as well?

Thanks

RE: NYS DEC Notice of Termination of Post Stormwater Practices

Someone has to do it. Check the maintenance plan in your SWPPP or erosion control plan.

Normally, the developer's inspection responsibility ends once the NOT is accepted, and the owner &/or tenant bears the responsibility for future inspection and maintenance of the system.

RE: NYS DEC Notice of Termination of Post Stormwater Practices

Are you talking about the Qualified Inspector inspections required during construction under the Construction Activity General Permit for erosion and sediment control (E&SC)?
(webpage:  http://www.dec.ny.gov/chemical/43133.html)
(2010 General Permit:  http://www.dec.ny.gov/docs/water_pdf/gpsconspmt10.pdf)

if so, then once construction is complete, Final Stabilization of vegetated areas is achieved and the permanent stormwater controls (if any) are operating, then you can file the NOT and end the construction E&SC inspections.  Read the relevant sections in the General Permit for explanation.

The operation and maintenance plans for the permanent controls should specify the post-construction inspection requirements for the BMPs after construction during operation and who should conduct them.
