I'd like to get a second opinion from guys who've done seismic evaluations of existing buildings before.

I'm working on a 4-story building with 1 level of basement. It's a type S4 building. The basement level footprint is wider at 4 sides to the typical floor footprint of the building (offset at 4 sides from the basement retaining walls). The 4 sides of the basement are concrete retaining walls, which also serve as additional shear walls for the 1st floor level, triggering the geometry non-compliance rating. The rest of the concrete shear walls (within the typical floor footprint) are full height to the roof and do not change at all.

To avoid triggering a non-compliant rating for building geometry (either tier 1 or 2), am I allowed to ignore the retaining walls at the perimeter of the basement if I can show that the remaining shear walls are adequate for the pseudo lateral force?

I'm trying to avoid doing the lengthy Linear Dynamic Procedure for Tier 2 screening. This building is located in Phoenix, AZ (we have a very low earthquake probability) but rated moderate per 31-03 and working on Life Safety performance level. thanks!
