Question:  Can you use non-compact sections in a moment connection?

I am designing a moment connection in a steel moment frame.  The column is a HSS6x6x3/16 with a W8x28 beam cantilevering over the top.  The connection will be an end plate on top of the HSS connecting to the beam flange.

I am using a software program called Limcon and it does not allow non-compact section to be used in a moment connection.  What code reference is this program using?

The seismic provisions of AISC establish more stringent rules for the slenderness of the plate components or thicknesses of pipes. If earthquake is one of the hypothesis, the answer may be this.
