Hello,

Here's the situation:

A utility company built a generating station on the grounds of a industrial facility for the purpose of providing the exhaust heat from the gas turbines to the industrial facility.  Additionally, the gen station is tied into the industrial facilities distribution system.  The cogen (waste heat) operation has never been put into use, so the units are operated as simple cycle units.  The units are bid into the ISO and are dispatched by the ISO, except for rare times when the industrial takes the sub out for maintenance.

The question has come up over whether the facility is classified as being under MSHA or OSHA regulations since the industrial facility is a mineral processor and under MSHA rules.  The raw material is brought in by trucks.

In the MSHA rules, mineral processing facilities are under their jurisdiction.  OSHA rules state that generating facilities are under their jurisdiction.

Since this generating facility, is housed in a separate building, paid for and constructed by the utility but on the industrial facilities land, is this facility under OSHA jurisdiction?
