with scan to 3d, but how can we use this geometry as points? It will not allow us to select the points to drive curve geometry.

Have you tried creating a spline in a 3D sketch?  You can place spline curve points on the points floating in space to get what you need--at least roughly.  It takes time, but ought to work fine.

With the Scan to 3D use the Mesh prep wizard and follow each step it will mesh the point cloud data.
