I have downloaded an assembly (native solidworks) with a layout sketch that drives the stroke.  I added a configuration (by changing the layout sketch depending on current config) for the stroke and it behaves as it should.  However when I insert this assy in the upper level assy and have two configs one default and one stroked you seem to only get the config last saved.  Even doing a rebuild or resolve does not change the assy as it should.  Looks like the top down sketch is not rebuilding.  Any ideas?

You have to change one of the instances of sub-assy to teh other configuration. Right click and go to component properties.

From your post, I see that you have already changed the configuration of one of the instances of the subassembly.

It probably has something to do with the way you can only edit a dimension of the active configuration of a part.  Consider changing the mating scheme of the downloaded subassembly.

Ah, I think I may understand now.  When you say "drives the stroke", you mean the overall stroke length of the downloaded component, not where it is in its particular stroke.  Like you have a cylinder with a 6" stroke and you also want one with a 4" stroke.  The layout sketch drives the length of the components of the subassembly, so each component of the subassembly that changes with stroke will have to have a different config for each stroke length.  To continue with the cylinder example, let's say that the rod length and the cylinder tube are the only 2 components that change.  You will need a separate config of each of those for each different length you want.  This is because you can't have one config of one part be two different lengths at the same time.
