Does VIII–1 restricts apply of nozzle made of SA-479 (316L on shell of SA-240 316L) ?

Yes. Per ASME Section II, Part D, Section VIII, Div 1 only permits SA-479 316L up to 850 deg F service temperature because of the lower carbon content.
